Customer Discretion - Each reservation is for a specified number of guests or rooms. We reserve the right to charge for any additional guests/ rooms.

Reservation/Damage Deposit - A reservation deposit of $1,500 USD is required for any Casa (home) and $750 USD for any 2 bedroom condo. This must be received within four (4) days of booking the reservation. No reservation will be held until funds are received. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (10) days of departure, provided there is no damage or outstanding balance.

Payment – The full rental rate is required 45 days prior to arrival. LLV reserves the right to cancel the reservation for non-payment.

The reservation deposit will be accepted via check or credit card payment only.

The rental balance can be paid via:

• Master Card ,Visa, American Express through a Pay Pal invoice emailed to you.

• Direct Pay Pal account payment

• Mail a personal check, money order, cashiers check

• Direct deposit into a Wells Fargo account

• Cash Payment Upon Arrival.

The security deposit will show as a charge on your card, however, will be fully refunded as a credit on your same card assuming there is no damage. The alternative is to send a check or money order. The security deposit will be cashed and fully refunded via check to the address you provide.

Cancellations– A ninety (90) day notice is required for cancellation. Cancellations that are made more than ninety (90) days prior to the arrival date will incur only a $150 USD processing penalty and the remaining security deposit will be refunded. Cancellations or changes that result in a shortened stay, that are made within 90 days of the arrival date, forfeit the full advance reservation deposit. The remaining balance will be refunded. Cancellations made within 30 days of the arrival date will forfeit the entire rental. The deposit will be refunded. Early departure constitutes a cancellation and will not be refunded.

La Laguna Villas reserves the right to make alternate rental arrangements of equal or better accommodations in quality and size if the agreed property is not available or is unsuitable for reasons beyond our control due such as acts of God, major construction problems that are unforeseen, and so on.

Monthly Reservation Cancellations – Monthly renters must cancel one hundred twenty (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in.

Minimum Stay – Three (3) Night Minimum Stay is required. Longer minimum stays may be required during holiday periods.

• November 22nd- November 30th

• December 20th - January 3rd

Daily Maid Service – While linens and bath towels are included in the unit, daily maid service is not included in the rental rate, however, is available at an additional fee. The maids will typically spend about 2-3 hours and will do laundry if requested. We suggest you bring beach towels. We do not permit towels or linens to be taken from the units. Rentals that are one week or longer will have a mid week cleaning included.

Transfers- La Laguna Villas can arrange a private transfer via Escalade/Suburban from the San Jose del Cabo International Airport to the resort on request. Due to local union regulations, transfer must be reserved 72 hours prior to the arrival date. Please contact the concierge for arrangements.

Itinerary and Concierge - La Laguna Villas has a concierge/rental agent available to discuss the many options available for fun, sun, and adventure or simply relaxing and treating yourself in Los Cabos. Many visitors to El Encanto find the chef or spa services to be a wonderful experience to enjoy from the privacy of your home or condo. The pre-arrival grocery stocking is very convenient for those that want to arrive with no worries. For more adventurous ideas the ATV adventure tours is an exhilarating experience, snorkeling expeditions, kayaking, boating, and fishing are amongst the more popular activities. Simply discuss with the rental agent the options available.

Hurricane or Storm Policy – No refunds will be given due to storms, however, if the renter chooses to leave or not arrive due to a Hurricane or Tropical Storm a full credit of the unused days will be given for the same property or equal to be used within a one year period of the original booking.

Community Rules

Smoking: All units within El Encanto de La Laguna are NON SMOKING units. If smoking outside please be courteous of your neighbors.

Pets are not permitted in rental units under any conditions. (Only Casa Radda permits dogs)

Balconies/Patios: Private balconies and patios are not intended for storage. Bicycles and patio furniture are the only items that may be placed or stored on the balcony or patio. Other personal items, including, but not limited to Towels, wetsuits, pool toys, beach toys, and general clutter, must be stored elsewhere or disposed of properly and not visible from outside of the property. It is not permitted to hang items over rails to dry.

Disturbances: At all times during the rental period, residents shall conduct themselves, and require other persons on the Premises with their consent to conduct themselves, in a manner that does not unreasonably disturb his neighbors or constitute a breach of the peace. Tenants shall not make or permit any disturbing noises in the building by a tenant or tenant's family, employees, agents, visitors or licensees, nor do or permit anything by such persons that will interfere with the rights, comforts or convenience of other residents. Residents shall not play or allow to be played, any musical instrument or operate audio-visual equipment on the premises, or on the exterior of said premises, if it disturbs or annoys other occupants of the building.

Noise Violation Policy: First offense gets warning from security and must sign a warning; second offense gets $250. U.S. Dollar fine to be taken from the Security Deposit Immediately and paid to the community HOA, the security deposit must be replenished to the full amount immediately the following day otherwise the tenant will be evicted with no refund ; third offense gets $1,000. U.S. Dollar fine (plus previous $250. U.S. fine) and police gets called, this will cancel rental agreement. Quiet hours of 10:00 p.m. to 7:00 a.m. must be observed.

Garbage: No garbage or other refuse shall be stored or allowed to accumulate on the premises for extended periods of time. If any bags of garbage are left outside of the front door or along the side of the street without being disposed of immediately there will be a $50. Fine taken from the security deposit immediately.

Heating and Cooling: The renter is allowed to use the controls of the swimming pool/Jacuzzi/air conditioning units. We ask that you be courteous and turn off the heater of the Jacuzzi when it is not in use. Only persons employed by the property owner or his agents shall operate, or have anything to do with the actual heating system or cooling system on the premises such as the pool heaters or air conditioning condenser units.

Lockout: In the event that the tenant locks themselves out of their premises, they may obtain an additional key from the rental agent. The tenant must pay the $25. Replacement fee out of the deposit if the key is lost.

Plumbing: Each home has it’s own private waste treatment system. The systems are not meant to handle large amounts of paper/ or any foreign chemicals. The systems use live bacteria to breakdown waist and are disrupted by the introduction of foreign chemicals not intended for normal bathroom/kitchen use. Do not use draino or any type of unclogging chemical. Contact the rental agent immediately for assistance. The tenant shall keep the sink, lavatory drains and commode lines in good operating condition.

Repairs and Unsafe Conditions: Tenant agrees to notify property owner immediately and follow up in writing of any necessary. Repairs or unsafe condition of any kind within the rental property or common areas.

Use of Phase 1 Common Area Pool: Anyone renting a private home has the right to beach access or access through any of the community streets, however, do not have the right to use the common area pool of the phase I condos. This pool is a private area for those that live there or are renting a unit in the phase I condo area.

BBQ Use: Tenants are permitted to use the gas BBQs located on the premises, however, tenants must use the brush provided to clean the grill thoroughly after use and turn off the gas. The tenant will be charged a gas bill if the gas is left on.

Waiver of Liability: LLV (La Laguna Villas) & it's staff act only as agents for the customer, and shall not be held liable for claims, losses, damages, costs, or any expenses arising out of injury, accident, death, delay, distress, inconvenience, scheduling changes or frustration to the customer. Owners of the properties represented may have limited or no liability insurance coverage. Customer agrees that any claim must be made through a court of law in Mexico.

Assumption of the Risk: The vendors that provide activities, tours, and transportation are independent contractors and are not agents or employees of LLV. Some activities that guests engage in are inherently dangerous including, but not limited to, motorcycle, scooter and four-wheel (ATV) riding or rentals, horseback riding, scuba diving, deep-sea fishing, golfing, pool and ocean swimming and surfing.

Each guest agrees that he/ she is voluntarily participating in any and all activities, understanding that he/ she any and all risk of injury, illness damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. The tenant and his/her guests acknowledge that conditions, including but not limited to, accommodations, activities, tours, services, roads, traffic laws, transportation, sanitation (water and food), building standards, insurance practices, and medical care are not as strictly regulated as those in the United States.

Guests may encounter conditions with risks including, but not limited to, slippery floors, steps, and decks, especially when wet, precipitous drop offs at or around some of the residences, unfenced pools, poorly designed or faulty electrical, plumbing and gas systems. The tenant and his/her guests acknowledge that they may also encounter dangerous driving conditions, poorly maintained or equipped vehicles and dangerous stairs or pathways.
